New York has strict DWI laws with different levels of alcohol-related offenses. A BAC of .08 percent or higher results in a DWI charge, while over .18 percent leads to aggravated DWI. Even a BAC between .05 and .07 can lead to a DWAI charge.
Leandra’s Law, passed in 2009, requires anyone convicted of DWI to install an ignition interlock device (IID) in any car they drive for a period of 12 months. CDL license holders cannot get a conditional license, only regular license holders are eligible. Those seeking a conditional license must also install an approved ignition interlock device in New York.
