FACTS AND ALLEGATIONS
The subject accident occurred on November 11, 2015, at 9:47 pm in Brooklyn, New York. Plaintiff was a passenger of her vehicle and was T-boned by another vehicle. Plaintiff was wearing her seat belt at the time of the accident, but the impact caused her to be thrown back and forth and into the driver’s side window. INJURIES/DAMAGES
Plaintiff was a passenger of an accident where she was removed by ambulance and taken to Brookdale Hospital. X-Rays confirmed that she had fractured the vertebrae in her lower lumbar spine and injured her shoulder. Plaintiff, upon discharge, underwent medical testing and MRI’s revealed that she had tears in her shoulder and complained of shoulder pain. She was referred to an orthopedist and underwent arthroscopic surgery of her right shoulder. Plaintiff began a course of pain management and received two epidural injections to her lumbar spine. Plaintiff continued to undergo physical therapy twice a week for ongoing pain in her lumbar spine and had limitations caused by her injuries.
Plaintiff was awarded Summary Judgment against the Defendants for her non-negligence as a passenger of the accident. Plaintiff’s treating physicians claimed that her injuries were causally related and she had no injuries prior to her accident. Plaintiff’s case settled for the policy limits of both vehicles within 8 months of her accident and 2 months following her deposition.
SETTLEMENT AMOUNT
