FACTS AND ALLEGATIONS
The Plaintiff was descending his steps in his apartment building when he slipped and fell due to a chronic leaking roof condition. As a result of slipping, the Plaintiff was caused to fall down a flight of steps and re-injured his back. He also fractured his ribs and injured his shoulder. Investigation confirmed from the Department of Buildings that his apartment complex had been cited for numerous violations of a leaking roof condition prior to the accident. Plaintiff had been disabled from a prior worker’s compensation accident where he underwent lumbar spine surgery.
INJURIES
Our client slipped and fell down a flight of stairs causing him to fracture his ribs, re-injure his back, and injure his shoulder. Emergency services soon arrived after his accident and our client was taken to a Hospital where X-Rays confirmed rib fractures. Arthroscopic surgery was performed within months of his accident and he underwent lumbar spine revision surgery 2 years after his accident.
